These Terms & Conditions (“Terms”) govern your access to, and use of the website located at https://guiltypleasurecigars.store (the “Site”) and any purchases made through the Site. The Site is operated by Guilty Pleasure Cigars, LLC (“Guilty Pleasure,” “we,” “us,” “our”). By accessing the Site or placing an order, you agree to these Terms.

1) Eligibility and Age Requirement (21+)

This Site and all products offered are intended for adults 21 years of age or older. By accessing the Site and/or purchasing from us, you represent and warrant that you are at least 21 years old. We do not sell tobacco products to anyone under 21, consistent with federal law.

We reserve the right to:

• require age and identity verification at any time (including after checkout),

• cancel or refuse any order if verification cannot be completed, or if we suspect the purchase is for or by an underage person.

2) Health Warning and Assumption of Risk

Cigars contain tobacco and nicotine. Tobacco use may cause serious health risks. You acknowledge and accept all risks associated with tobacco use and assume full responsibility for your purchase and use of our products.

3) Compliance With Laws; Restricted Sales

You agree to comply with all applicable federal, state, and local laws and regulations regarding the purchase, possession, use, and shipment of tobacco products.

We may, in our sole discretion:

• restrict or refuse sales to certain jurisdictions,

• cancel orders that cannot be legally shipped or delivered,

• require additional compliance steps for delivery sales.

Note: Online/delivery sales of tobacco products can trigger additional obligations under federal and state law (including registration and reporting requirements in certain circumstances).

4) Orders, Pricing, and Payment

All prices are listed in U.S. dollars unless stated otherwise. Prices, product availability, promotions, and descriptions may change without notice.

We reserve the right to:

• limit quantities,

• refuse service,

• cancel orders due to suspected fraud, errors in pricing, or inventory issues.

If we cancel an order after payment, we will issue a refund to the original payment method.

5) Taxes

You are responsible for all applicable taxes. We may collect and remit sales taxes and other taxes as required by law based on the shipment destination and other applicable factors.

6) Shipping, Delivery, and Adult Signature

a) Shipping Restrictions

Shipping rules vary by carrier and destination. Certain carriers and destinations may restrict tobacco shipments. We reserve the right to choose or change carriers and shipping methods.

b) Adult Signature / Age-at-Delivery

We may require Adult Signature (21+) at delivery and may use delivery methods that verify age at the door. If a package is refused, undeliverable, or returned due to age-verification failure, incorrect address, or unavailability of an adult recipient, you may be responsible for shipping/handling fees and restocking fees where permitted by law.

c) USPS (If Applicable)

USPS indicates that cigars may be mailed domestically (subject to USPS rules and definitions). We may choose not to use USPS depending on destination or operational requirements.

d) Risk of Loss

Risk of loss transfers to you upon delivery confirmation by the carrier (or as otherwise required by applicable law). Please inspect shipments promptly upon receipt.

7) Returns, Refunds, and Final Sale

Due to the nature of tobacco products, all sales are generally final for opened or used items. If you receive the wrong item, damaged product, or an order issue caused by us, contact us within 48 hours of delivery at info@guiltypleasurecigars.store with photos of the issue and the packaging. We will evaluate and, where appropriate, offer a replacement, store credit, or refund at our discretion and as permitted by law.

We do not accept returns for:

• buyer’s remorse,

• improper storage after delivery,

• product damage caused after delivery.

8) Product Storage and Quality

Cigars are sensitive to temperature and humidity. Proper storage is required. We are not responsible for changes in condition due to improper storage or handling after delivery.

9) Promotions and Discounts

Promotions are subject to change or cancellation at any time and may be limited by product, quantity, or date. Promo codes cannot be combined unless explicitly stated.

10) Intellectual Property

All content on this Site—including trademarks, logos, band designs, product names, images, graphics, and text—is owned by or licensed to Guilty Pleasure Cigars, LLC and is protected by intellectual property laws. You may not use our content without written permission.

11) Prohibited Use

You agree not to:

• use the Site for unlawful purposes,

• attempt to purchase for minors or resell to minors,

• interfere with Site security or operations,

• use bots/scraping to collect pricing, content, or customer data.

12) Disclaimer of Warranties

THE SITE AND PRODUCTS ARE PROVIDED “AS IS” AND “AS AVAILABLE.” TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

13) Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, GUILTY PLEASURE CIGARS, LLC SHALL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUE, ARISING OUT OF OR RELATED TO YOUR USE OF THE SITE OR PRODUCTS.

OUR TOTAL LIABILITY FOR ANY CLAIM ARISING FROM A PURCHASE SHALL NOT EXCEED THE AMOUNT YOU PAID FOR THE PRODUCT(S) AT ISSUE.

14) Indemnification

You agree to indemnify and hold harmless Guilty Pleasure Cigars, LLC and its owners, employees, and agents from any claims, damages, liabilities, and expenses arising from your breach of these Terms, misuse of the Site, or violation of any law (including purchasing for or providing products to minors).

15) Dispute Resolution; Governing Law; Venue

These Terms are governed by the laws of the State of Michigan, without regard to conflict-of-law rules.

Any dispute arising from these Terms or your purchase shall be brought in the state or federal courts located in Oakland County, Michigan, unless otherwise required by law.

16) Changes to These Terms

We may update these Terms from time to time. The “Effective Date” will indicate when changes take effect. Continued use of the Site after changes means you accept the updated Terms.
